South African Legal Compliance
This Network Marketing program complies with South African legislation including the Consumer Protection Act 68 of 2008, the National Credit Act 34 of 2005, the Protection of Personal Information Act (POPIA), and the Electronic Communications and Transactions Act 25 of 2002. All MLM activities are conducted in accordance with South African law.

Important Notice
Participation in the New Genesis Network Marketing program is voluntary and subject to these terms and conditions. By joining the MLM program, you agree to abide by South African consumer protection laws, data protection regulations, and fair trading practices.
1. Definitions
- Independent Members/Member: A person who joins the network to market and sell the company's services/products.
- Downline: Members who introduce New Genesis under a specific member.
- Upline: The sponsor of a given member.
- Commission: Payment earned through legitimate network marketing activities.
- Direct Selling: The marketing and distribution of products/services directly to consumers.
2. Membership Eligibility
- Must be 18 years or older.
- Must have a valid South African ID or legal residency permit.
- Must have an active New Genesis funeral policy.
- Must agree to all terms and complete the MLM registration process.
- Must comply with South African consumer protection laws.
3. Commission Structure
South African Law Compliance:
All commissions are paid in accordance with the Consumer Protection Act and National Credit Act. Commissions are only paid for legitimate sales and recruitment activities.
- Commission will only be paid if the member has paid their New Genesis monthly premiums. No premium. No commission.
- Members are paid when their downline member pays their monthly premium.
- Recurring commissions are earned as long as the client pays and maintains active membership.
- Bonuses may be earned through rank advancements or targets met (subject to South African consumer law).
- All commissions are declared to SARS and subject to South African tax regulations.
4. Payout Terms
- Commissions are paid monthly into the registered South African bank account.
- All payments comply with South African financial regulations and anti-money laundering laws.
- Payments are subject to verification of all transactions and member eligibility.
- Any disputes must be lodged within 7 days of payout in accordance with consumer protection laws.
- Minimum payout thresholds may apply as per South African banking regulations.
5. Code of Conduct & South African Law
Legal Obligations:
All members must comply with South African consumer protection laws, POPIA (Protection of Personal Information Act), and the Electronic Communications and Transactions Act. Misrepresentation or false claims are illegal.
- No misrepresentation of products, services, or earnings potential.
- No false claims, coercion, harassment, or pyramid scheme activities (illegal under South African law).
- Members must follow POPIA and all relevant South African data protection laws.
- All marketing materials must be approved and comply with consumer protection regulations.
- Fair trading practices must be maintained at all times.
- No discrimination or unfair business practices.
6. Termination
The company reserves the right to terminate membership due to breach of South African law or company policy:
- Fraudulent activity or violation of consumer protection laws
- Misconduct or misrepresentation
- Breach of contract or these terms
- Non-compliance with South African regulatory requirements
- Failure to maintain active membership status
Termination will be handled in accordance with South African employment and consumer protection legislation.
7. Transfer of Commissions Upon Death
- Upon written instruction, commissions may be transferred to a listed beneficiary (spouse or next of kin).
- Legal proof (death certificate and ID of beneficiary) must be submitted.
- All transfers comply with South African inheritance and estate laws.
- Beneficiary nominations must be updated regularly.
8. Tax Responsibility
SARS Compliance:
All members are responsible for declaring MLM earnings to SARS in accordance with South African tax legislation. New Genesis will provide necessary documentation for tax purposes.
- All members are responsible for declaring their earnings to SARS.
- The company will not withhold PAYE unless contracted as an employee.
- Tax certificates (IT3(a) forms) will be issued annually as required by South African tax law.
- Members must maintain accurate records for tax purposes.
9. Product & Policy Ownership
- All client policies and products remain under the control of New Genesis.
- Members do not own the client database or customer information.
- All marketing and sales activities must promote New Genesis products and services.
- Intellectual property rights remain with New Genesis.
10. Confidentiality & Data Protection
POPIA Compliance:
All member activities must comply with South Africa's Protection of Personal Information Act (POPIA). Personal information must be handled responsibly and legally.
- Members must keep client and company information confidential.
- No unauthorized disclosure of personal information or trade secrets.
- All data handling must comply with POPIA and other privacy legislation.
- Marketing activities must respect consumer privacy rights.
11. Amendments & Updates
- The company may update terms with reasonable notice to members.
- Continued participation implies acceptance of changes.
- All updates comply with South African consumer protection laws.
- Members will be notified of significant changes via email.
12. Dispute Resolution
- Disputes will be resolved through South African legal channels.
- Consumer complaints may be lodged with the Consumer Commission.
- The company commits to fair and transparent dispute resolution.
- All resolutions comply with South African consumer protection legislation.
